Terms and Conditions

DEFINITIONS
In these Terms and Conditions:
Black and White Taxis means Black and White Distribution Pty Ltd (We) trading as Black and White Taxis.
Cabcall is an automated answering service that is linked with the taxi dispatching software.
Metropolitan Taxi Control Area means the area designated by the Department for Planning and Infrastructure Passenger Services Business Unit where a taxi is permitted to operate as a Taxi.
Mobile Express means the service provided by Black and White Distribution Pty Ltd for requesting taxis via a Your mobile telephone.
Sunseeker Taxis means Black and White Distribution Pty Ltd trading as Sunseeker Taxis.
Taxi means a taxi vehicle operated by the Taxi Operator in the Perth metropolitan taxi control area.
You and Your means the person registered to use the Mobile Express service.
SERVICE
Black and White Distribution Pty Ltd makes available to You the Mobile Express service so that You are able to automatically request a Taxi via Your mobile telephone subject to these Terms and Conditions.
TERMS & CONDITIONS
You agree to the following:
a)You will use the Mobile Express service in good faith and You will not misuse or allow misuse of the service.
b)When requesting a taxi via Mobile Express you will use your best endeavours to ensure the correct pickup location number as registered by You is entered into the Cabcall automated service.
c)If, after requesting a taxi YOU no longer require the taxi, You will use your best endeavours to cancel the taxi as soon as You know that You will no longer require the taxi.
We agree to the following:
a)We will allow You to continue to use the service with quiet enjoyment whilst You observe these Terms & Conditions.
RIGHT TO TERMINATE
Black and White Distribution Pty at its sole discretion may terminate your registration without notice if You breach any of the conditions outlined in these Terms and Conditions.
Term
The term of Your registration is on-going unless terminated in accordance with these Terms and Conditions.
Black & White Distribution Pty Ltd not liable
Black & White Distribution Pty Ltd is not liable in respect of any loss or liability resulting from any accident, loss of life, injury, damage, malfunction or other event in or affecting the Mobile Express service.
